§ 1 Scope

These terms apply to all contracts between Shot2Pet (operator) and the user regarding the use of the Shot2Pet platform.

§ 2 Service description

Shot2Pet enables users to upload pet photos and receive algorithmically created artworks. No guarantee is given for a specific result, a specific likeness or a specific artistic quality. Credits are consumed as soon as the generation process has started, regardless of the result. Users can purchase watermark-free images as digital files or order them as prints.

§ 3 Usage requirements

Using the platform requires full legal capacity. Users must be at least 18 years old. By registering, the user confirms that they meet this requirement. The contract language is German.

§ 4 Credits

Upon registration, users receive free Credits. One Credit is consumed per image generation. 1 Credit = 1 image generation. Credits can be purchased in packages. The current price per Credit package is displayed in euros before purchase. Credits are non-transferable and non-refundable. Free Credits granted upon registration have no monetary value. Purchased Credits are valid indefinitely as long as the user account exists. Purchased Credits are single-purpose vouchers within the meaning of § 3 Abs. 14 UStG, as the place of service (Germany) and the applicable tax rate (19% VAT) are already determined at the time of purchase. VAT is therefore due upon acquisition of the Credit package and is included in the displayed purchase price.

§ 5 Prohibited use

The user commits to not using the platform for unlawful or abusive purposes. In particular, the following is prohibited:

  • Uploading images that show illegal, violence-glorifying, pornographic or otherwise offensive content
  • Uploading images of third parties without their consent or violating the rights of third parties
  • Using the platform to create deepfakes or deceptively realistic depictions of real persons
  • Performing automated access, scraping or other technical manipulation of the platform
  • Using the service for spreading spam or for other commercial purposes without permission

§ 6 Prices and payment

All displayed prices are final prices including statutory VAT. Payment is processed via Stripe. The purchase contract is concluded upon receipt of payment.

§ 7 Right of withdrawal

Digital content: For the purchase of digital downloads (image files), the right of withdrawal expires pursuant to § 356 Abs. 5 BGB as soon as the execution of the contract has begun. The user expressly agrees before completing the purchase that contract fulfillment begins immediately and thereby confirms the loss of the right of withdrawal.

Credits: When purchasing Credits, a 14-day right of withdrawal applies. The right of withdrawal expires pursuant to § 356 Abs. 5 BGB as soon as the user redeems Credits (i.e. starts an image generation), as this constitutes the beginning of contract execution. The user is informed of this before purchase and confirms their acknowledgement.

Print products: Print products are individually manufactured single pieces produced according to customer specifications (personalized goods). For such goods, there is no right of withdrawal pursuant to § 312g Abs. 2 Nr. 1 BGB. The user expressly confirms this before completing the purchase.

§ 8 Delivery

Digital products: Digital downloads are available for download immediately after receipt of payment.

Print products: Delivery time is approximately 10–14 business days after receipt of payment. Shipping is available to Germany and Austria only. Shipping costs are transparently displayed before purchase and depend on the size of the ordered product.

§ 9 Copyright and usage rights

AI-generated images do not enjoy copyright protection under current law within the meaning of § 2 UrhG, as they do not constitute a personal intellectual creation. Shot2Pet assumes no warranty for the protectability of the images.

Upon purchase, the user receives a comprehensive, non-exclusive, worldwide usage right to the generated image, including commercial use (advertising, merchandising, social media, print products). Not permitted is: (a) representing the image as a human-made work, (b) using it for the development of own AI or ML models. The uploaded original image remains the property of the user.

§ 10 Liability and warranty

Shot2Pet is liable without limitation for damages arising from injury to life, body or health as well as for damages based on intent or gross negligence. In cases of slight negligence, Shot2Pet is only liable for the breach of essential contractual obligations (cardinal obligations). In these cases, liability is limited to the foreseeable, contract-typical damage.

Warranty for digital products: Shot2Pet warrants the technical functionality of the delivered image files pursuant to §§ 327 ff. BGB (e.g., readability, agreed resolution). No guarantee is given for a specific artistic quality, likeness or a specific result of the AI generation — this does not constitute a defect.

Defect rights for print products: For physical products, the statutory warranty rights apply pursuant to §§ 434 ff. BGB (warranty period: 2 years). In the event of printing or transport defects, the user can submit a complaint by email to info@shot2pet.com with a photo of the defect. The provider decides after review whether to provide a replacement or refund. Returns are only made upon express request by the provider.

The user is responsible for uploaded images and ensures that no rights of third parties are violated.

§ 11 Data protection

The privacy policy at /legal/privacy applies.

§ 12 Account deletion and Credit expiration

The user may request the deletion of their account at any time by email to info@shot2pet.com. Upon account deletion, all Credits (both free and purchased) expire without replacement. Generated images are deleted within 30 days after account deletion. Invoices are retained in accordance with the statutory retention obligation (§ 147 AO) for 10 years.

§ 13 Provider rights

The provider is entitled to: (1) block or terminate user accounts in case of violations of § 5 of these terms without prior notice, (2) remove generated content in case of violations of § 5, (3) modify, restrict or discontinue the service or individual features at any time. In the event of a complete discontinuation of the service, users will be informed at least 30 days in advance by email. Purchased Credits can be used up within this period. After the period expires, unused Credits expire without replacement. In the event of a block due to abuse, there is no entitlement to a refund of fees already paid or Credits acquired.

§ 14 Availability

Shot2Pet strives for high platform availability but cannot guarantee uninterrupted accessibility. Maintenance work will be announced in advance when possible. No claims by the user arise from temporary unavailability.

§ 15 AI-generated content

All images created via Shot2Pet are generated by artificial intelligence. The results must not be represented as created by a human. Shot2Pet labels AI-generated content in accordance with the requirements of the AI Act (Art. 50).

§ 16 Dispute resolution

The European Commission provides a platform for online dispute resolution (OS): ec.europa.eu/consumers/odr. The provider is not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration body.

§ 17 Withdrawal form

Model withdrawal form pursuant to Anlage 2 zu Art. 246a § 1 Abs. 2 EGBGB: To Shot2Labs, info@shot2pet.com: I/We (*) hereby withdraw from the contract concluded by me/us (*) for the purchase of the following goods (*) / the provision of the following service (*): Ordered on (*) / received on (*): Name of the consumer(s): Address of the consumer(s): Date, Signature (only for paper notification). (*) Delete as applicable.

§ 18 Contract text storage

The contract text is not saved after the conclusion of the contract and is not accessible to the user. The terms can be viewed at any time at /legal/terms. The order confirmation by email serves as proof of the conclusion of the contract.

§ 19 Severability clause

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid regulation that comes closest to the economic purpose of the invalid provision shall apply.

§ 20 Amendments to the terms

The provider reserves the right to amend these terms. Amendments will be announced at least 30 days before taking effect by email. If the user does not object to the amendments within 30 days of receiving the notification, the amended terms are deemed accepted. In case of objection, the user has a special right of termination. These legal consequences will be specifically noted in the amendment notification.

§ 21 Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

§ 22 Contract language

The contract language is German. Translations into other languages are for information purposes only — in case of doubt, the German version prevails.
